Please kindly be informed, after series of discussion and consideration among the JMB committees. Finally we have made the decision to STOP the manually open the entrance gate by our “too friendly” guards or owner. We disconnect the manual open function. This direction is to give a strong signal to the selfish/errant owner/ irresponsible drivers who simply drive in without entrance access card and park their car anyway they like! This decision might cause some inconvenience but in order to make everything in place, safety and to be fair…. etcs, for us in JMB, it is the best and right move. Hope all owners understand and agreed with us. This will take effect on 17th Dec 2012. 
If you have any concern you can come to meet us for further discussion before the effective date.

居協及管理公司可對付拒絕支付管理費的圍篱保安社區(gated & guarded community)的屋主。(圖:星洲日報)
(吉隆坡27日訊)一旦國會通過2012年分層管理法案,圍篱保安社區(gated&guarded community)的屋主如拒付管理費,管理層有權向法庭申請庭令,查封其財物以進行拍賣,用以支付管理費。
房屋及地方政府部長拿督斯里曹智雄在接受星洲日報專訪時說,這是因為圍篱保安社區的屋主在購買有關產業時,已清楚知道每個月要支付管理費。此法令也適用於擁有圍篱的公寓。他說,原有的公共產業法令也已授權管理公司採取上述行動,但是沒有清楚注明,很多人並不瞭解。
他補充,因此,他在接任房屋部長後,花了很長的一段時間,跟不少過20個相關團體商討後,才擬出這項法案。
不過,他說,若保安社區(guarded community)的住戶,拒付保安費,政府則幫不上忙,因為屋主在購買屋子時,合約並沒闡明要支付保安費;他們是較後為加強社區保安,才自聘保安人員看守。
51%居民同意可設保安社區
此外,曹智雄也說,在房地部推出的新保安社區指南中,只要51%的居民同意就可以聘請保安,成立保安社區。目前則是需要80%的屋主同意。
自掏腰包聘請保安人員負責社區的保安,是屋主自願的,若餘下的49%屋主認為自己所住的地方很安全,無需聘請保安,那居協並不能強迫他們付費。
他指出,圍篱保安社區的道路屬於私人路段,因為發展商在發展住宅區時,圖測中已注明並獲得批准;因此,該住宅區的居民有權拒絕外人進入。
反之,保安社區的路段則屬於政府的公路,若有外人要駛入,保安人員不能禁止他們使用有關路段。

KUALA LUMPUR (Oct 28, 2012): Once the Strata Management Bill 2012 is enacted, the management of a gated community can apply for a court order to seize and auction the property of a delinquent house owner to offset management fee owed.
Housing and Local Government Minister Datuk Seri Chor Chee Heung told Sin Chew Daily in an interview published today that this is because house owners were fully aware when they purchased their property that they had to pay monthly management fee for security service rendered.
This rule also applies to gated apartments and condominiums.
The Strata Management Act 2012 (SMA) is to replace the Building and Common Property Act 2007.
Chor said in fact the Building and Common Property Act 2007 empowers the management of a gated community to take the aforesaid action against delinquent property owners, but many people are not aware of this as it is not clearly defined in the act.
He said he had spent a lot of time and talked to not less than 20 related organisations on this matter to come up with the new act
(SMA).
However, he said, the government cannot do anything if house owners in guarded communities refuse to pay for guards hired to watch over and patrol their areas, as it is not stated in the owners' sale-and-purchase agreement.
Chor also said that under the SMA, residents of a housing area need only obtain the consent of 51% of the residents to set up a guarded community, compared with 80% under the present law.
"Residents who hire guards to beef up security in a housing estate do it on their free will and out of their own pockets. If the other 49% of the residents believe the housing area is safe, and that they need not pay for additional security, they cannot be forced to do so," said Chor.
He pointed out that roads within a gated community are private property, and therefore residents within the community have the right to deny access to non-residents.
"On the other hand, roads within a guarded community are public property. The security guards have no right to deny non-residents access to the area."

Happy Malaysia Day (16 Sept 2012)






When is Malaysia Day?

Malaysia Day – September 16 2012, 2013 and every year
Malaysia day is in commemoration of celebrating the joining of North BorneoSingapore,Malaysia, and Sarawak, to form Malaysia. This formation was planned for June 1, 1963, but was postponed and took place on August 31, 1963.
This formation was made possible by the Malaysian Bill on July 9, 1963 as Yang di Pertuan Agong gave his consent. What makes Malaysia distinct is its diversity where different races and religions from both Sarawak and Sabah were welcomed by Malaysians more than 46 years ago on the September the 16th.
The people from Sarawak and Sabah made some noteworthy contributions to Malaysia that made it the tourism haven that it is today, where tourists can only but marvel because of the diversity and natural wonders displayed by the people of Malaysia. What is amazing, is that the sun shines on Sarawak and Sabah first.
